Most of our large cases such as medical malpractice are done on a contingency fee system. In the contingency fee system we are paid a percentage of the recovery as our legal fee. If we recover nothing then we get paid nothing. When our client cannot afford it we also advance case expense costs, including fees for expert witnesses, court reporters, and graphics for trial. When a case is concluded by settlement or verdict with payment we are then reimbursed for the advance case costs. A medical malpractice case is very expensive to pursue. Case costs can be up to several hundred thousand dollars if a trial is necessary although they are usually less.
Some people may believe the contingency fee system is not fair as the lawyer can earn a large fee out of proportion to the hours worked. Although on occasion the fee is large considering the hours worked there are many cases where the fee would be higher if charges were made on an hourly basis. We work hard on all of our cases and put in as much time as necessary to do a good job. We take the risk of losing and, if we lose, we lose not only our time but the advanced case costs. Finally, and most importantly, most people who are the victims of medical malpractice cannot afford to pay a lawyer hourly fees and expenses to pursue a case. The contingency fee system allows people who otherwise could not afford an attorney to be able to get highly qualified experienced attorneys to represent them. Legal aid services do not take difficult expensive cases such as medical malpractice cases. The parties we sue are usually wealthy and well insured and have the resources to hire the best lawyers to defend them; our fee system enables the playing field to be leveled.
